Just started checking one of these out for a friend that was having issues. Getting a variety of failures as shown in the pics. Usually it's an empty shell caught in the ejection port without anything being chambered but once in a while as you can see in the second picture it will partially chamber. It's been cleaned really well, not sure how many rounds have been through it but at least a few hundred. Tried 165's and 180 grain, same result. He's not the first owner so from what I read their warranty doesn't apply. Where do I start first?

While the warranty may not officially apply I'd be very surprised if they wouldn't work with you. A friend who was at least the 3rd owner of his SU16 had to pay $40 to transfer warranty and then they replaced the whole gun (with one with the same serial).

I had very similar issues with my Gen2 40cal Sub2k. I ended up doing a few things after reading some other similar posts;
Check the bolt. If it is hard to remove and scarred up, it may be scratched to the extent that it is affecting it's performance. Mine was scratched from a rough edge on the holes for the pin that holds the butt of the stock in place. These two holes had a rough edge and whenever I feild stripped to clean, the bolt would bet scratched pretty bad. Got to the point that it was very difficult to get the bolt out. to address this I first field stripped, then took a drimmel with a rounded grinding bit and smoothed out the edges of those two holes. I also sanded and polished any scratches out of the bolt.
This seemed to help. It also made field stripping and cleaning much easier.

I was still, however, having the same FTE and FTF issues. I next got the heavy brass bolt and Sumo charging handle to add weight to the bolt assembly. This did the trick. The added weight slowed the cycling down just enough. I have not had a single hickup since installing these two items.

Both are highly recommended upgrades if you own a .40. I've had outstanding results as well.

My 40 cal had a burr and I also needed to deburr the holes. It took about a minute.

I have also had good results with the heavy bolt and Sumo charging handle with my .40 S&W. The brass bolt had a pretty good sized gouge in it, so I filed it down smooth and polished the whole thing. Works great, very smooth.

My gen 1 .40 had a few break in issues that disappeared when the parts mated to each other.
I have had no gun related failures once it was broke in.
Looking at your ejection port. Man, that looks beat up.
If the heavy bolt doesn't work for you, you may want to send it to the factory.

Great to hear! So many people who've had issues with their .40 have seen similar positive results. Keltec should add 100grams of weight to the bolt assembly on the .40 sub from the factory. From my experience the extra 100 grams achieved via the heavy bolt and more significantly the sumo handle yields the following improvements:

Increased reliability
Reduced recoil
Less battering of weapon (reduced bolt slam to rear)
Easier on brass (important for reloaders)
Less accumulated powder residue in receiver.

I've yet to hear of any complaints or negative implications of these mods.
